Section 42
Protection from liability related to checks
: No claim, complaint or legal action can be taken against the Government of Nepal or any employee of the post office in the following matters:-
(a) any act done under any rule made under this section, or
(b) If the person sending the check gives the name or address of the person to whom the check is to be paid, the name or address of the person to whom the check is to be paid is incorrect or incomplete, and the payment is incorrect, but such incomplete name is due to reasonable grounds to believe that sufficient details have been obtained to know the identity of the person to whom the check is to be paid. or if the address is accepted, the employee of the post office concerned shall be freed from complaint, complaint or legal action in case of incorrect payment due to incomplete name or address, or
(c) the refusal or delay in payment of any check due to any ordinary accidental omission other than willful fraud or negligence on the part of the post office staff, or
(d) if the check is paid incorrectly after a period exceeding 1 year from the date of dispatch, or
(e) Any employee of any post office other than under the Government of Nepal, Nepal …………. For wrong payment or late payment of any check abroad.
